<p><strong>New publication: Chapter “Greece” in IEL Insurance Law</strong></p>

<p>We are pleased to announce the release of the new edition of the collective, multijurisdictional book “Insurance Law” (ed. by Prof. Dr. Herman Cousy), forming part of the comparative law series “International Encypoaedia of Laws”, in which our Senior Partner, em. Prof. I. Rokas, along with our Senior Associate, Kosmas Karanikolas, have authored the Chapter for Greece.</p>
<p>The Chapter in question provides a concise overview of Insurance Law in Greece, seen from both a contractual and a regulatory viewpoint. The monograph :</p>
<ul>
<li>Briefly outlines the socio-political and economic environment of Greece and the current status of the local insurance market,</li>
<li>Explores the fundamental aspects of all insurance contracts (insurable risks, contracts’ formation, parties’ obligations, etc.),</li>
<li>Delves into the operation of individual classes of insurance which are prevalent in the local market, such as marine and MTPL insurance,</li>
<li>Summarizes the essential regulatory provisions related to the pursuit of (re)insurance by insurance undertakings licensed in Greece or in other EEA countries, conducting cross-border activities, and</li>

<p><strong>Foreign Insurance Company’s Legal Representative in Litigation</strong></p>

<p>The legal issue of whether the authorized agent of a foreign entity in Greece may become a party to a dispute arising from a legal relationship involving such foreign company has occupied the legal community numerous times. A well-substantiated answer to this question was provided by the Hellenic Supreme Court of Cassation (Areios Pagos) in Decision No. 1303/2024, which, by defining the concept of the &#8220;party&#8221; to legal proceedings, distinguished between the concepts of the direct representative and the special representative of a foreign insurance undertaking. The authorized agent, under the definition of L. 4364/2016, implementing Directive Solvency II, is a direct representative, as defined in civil law, whereas the special representative, under the definition of the aforementioned Law, which is appointed by foreign insurance undertakings providing motor vehicle third party liability insurance in Greece under the Freedom of Services regime (FoS), operates as an assistant to the fulfillment of the entity’s obligations. In both cases, the foreign insurance company remains the subject of the contractual relationship. Decision 1303/2024 (of the Supreme Court of Cassation) concerns a dispute involving the foreign insurance company “Lloyd&#8217;s Insurance Company S.A.”, based in Brussels, Belgium, which is lawfully represented in Greece pursuant to Law 4364/2016 by “Lloyd’s of London (Representative Office) HELLAS – Single-Member Private Company”, based in Athens. The Court held, though, that the its lawful representative of the latter in Greece does not become a party to legal proceedings.</p>

<p>Ουκ ολίγες φορές έχει απασχολήσει τον νομικό κόσμο η προβληματική εάν ο νόμιμος αντιπρόσωπος αλλοδαπής εταιρίας στην Ελλάδα δύναται να καταστεί διάδικος σε ανακύπτουσα διαφορά συνεπεία της έννομης σχέσης με υποκείμενο την αλλοδαπή εταιρία. Τεκμηριωμένη απάντηση στο ανωτέρω ερώτημα έδωσε ο Άρειος Πάγος με την με αριθμό 1303/2024 απόφασή του, η οποία ερμηνεύοντας την έννοια του διαδίκου, προέβη παράλληλα σε διάκριση των εννοιών του άμεσου αντιπροσώπου και του ειδικού αντιπροσώπου μίας αλλοδαπής ασφαλιστικής επιχείρησης. Ο <strong>νόμιμος αντιπρόσωπος</strong>, κατά την έννοια του ν. 4364/2016 που μετέφερε την Οδηγία Solvency ΙI, αποτελεί άμεσο αντιπρόσωπο, κατά την έννοια του γενικού δικαίου, ενώ ο <strong>ειδικός αντιπρόσωπος</strong> κατά την έννοια του ιδίου νόμου, που διορίζεται από αλλοδαπές ασφαλιστικές επιχειρήσεις, οι οποίες ασκούν υπό καθεστώς ελεύθερης παροχής υπηρεσιών ασφαλίσεις αστικής ευθύνης από ατυχήματα αυτοκινήτων, λειτουργεί κατ’ ουσία ως βοηθός εκπλήρωσης των σχετικών υποχρεώσεων της ασφαλιστικής επιχείρησης. Και στις δύο περιπτώσεις, υποκείμενο της έννομης σχέσης παραμένει η αλλοδαπή ασφαλιστική εταιρία. Στην υπ’ αρ. 1303/2024 του ΑΠ η διαφορά αφορά την αλλοδαπή ασφαλιστική εταιρία «Lloyd&#8217;s Insurance Company S.A.», που εδρεύει στις Βρυξέλλες του Βελγίου, η οποία αντιπροσωπεύεται νόμιμα στην Ελλάδα, δυνάμει του ως άνω ν. 4364/2016 (άρθ. 115), από την ανώνυμη εταιρεία «Lloyd&#8217;s of London (Γραφείο Αντιπροσωπείας) ΕΛΛΑΣ -Μον. <p>This comprehensive update offers a detailed overview of the <strong>Greek insurance legal and regulatory framework</strong>, as well as recent market trends and structural developments. It reflects the dynamic evolution of the Greek insurance sector, which continues to adapt and thrive amid macroeconomic challenges, post-pandemic recovery, and European legislative developments.</p>
<p><strong>Key Developments Covered in the Update:</strong></p>
<ul>
<li><strong>Regulatory Framework</strong>:<br />
Greek insurance undertakings operate under a regime aligned with <strong>EU law</strong>, notably the <strong>Solvency II Directive</strong> (transposed by Law 4364/2016), the <strong>Insurance Distribution Directive (IDD)</strong> (via Law 4583/2018), and national accounting standards (under Law 4308/2014).<br />
Foreign insurers from EU/EEA countries may operate in Greece through <strong>Freedom of Establishment (FoE)</strong> or <strong>Freedom of Services (FoS)</strong>, while third-country insurers may enter the market only via a <strong>branch or subsidiary</strong>.</li>

The share of insurance company investments in Greek GDP stood at <strong>7.64%</strong>, reflecting their role as major institutional investors.</li>

The update addresses shifts in distribution channels, including the expansion of <strong>bancassurance</strong> and <strong>digital platforms</strong>, as well as M&amp;A activity reshaping the competitive landscape. <p><strong>Introduction</strong></p>
<p>The insurance undertakings in Greece are distinguished into those practising life</p>
<p>insurance, those practising non-life insurance, and the composite ones that practise</p>
<p>both (life and non-life), depending on the relevant licence granted by the supervisory</p>
<p>authority, the Bank of Greece (BoG). The Greek insurance market&#8217;s overall gross premium</p>
<p>production is significantly lower than the EU average, among others, due to the extensive</p>
<p>social security system that covers a substantial portion of private insurance activities,</p>
<p>such as compensation in the case of an accident at work. However, according to a</p>
<p>survey conducted by the Hellenic Association of Insurance Companies (HAIC) among its</p>
<p>members, the total premium production in 0408 increased by 7.€ per cent compared to the</p>
<p>previous year, reaching 56.97 billion. HACI2&#8217;s statistics specifically indicate that in 2024, the</p>
<p>gross premium production increased by 7.9 per cent in life insurance and by 9.4 per cent</p>
<p>in non-life insurance.</p>
<p>The role of insurance intermediaries is very important in the Greek market, as most</p>
<p>insurance policies are concluded through an insurance intermediary, while only a small</p>
<p>percentage is concluded by means of direct sales. There is a notable trend towards</p>
<p>concentration in both markets, of insurance undertakings and insurance intermediaries.</p>
<p>There are a great deal of EU-based entities operating in Greece via the regime of</p>
<p>establishment or the freedom of services, and very few examples of non-EEA undertakings</p>
<p>that have established a licensed branch in Greece.</p>

<p>Artificial Intelligence (AI) is rapidly reshaping the insurance industry. Over the past three years, it has evolved from a buzzword into a powerful operational force—<strong>80% of insurers</strong> now use AI to automate processes, assess risk, detect fraud, and personalize customer experiences.</p>
<p>AI-driven tools are streamlining claims handling, analyzing massive datasets for better decision-making, and enhancing customer interactions via 24/7 virtual assistants. In Greece, insurers like <strong>Groupama</strong>, <strong>ERGO Hellas</strong>, and <strong>Eurolife FFH</strong> are leading the charge, launching AI-based services such as chatbots and digital policy purchases, including for niche products like pet insurance.</p>

<li><strong>Solvency II Directive:</strong> Requires AI to be integrated into insurers’ governance and risk management frameworks</li>
<li><strong>EU AI Act:</strong> Imposes strict governance, transparency, and oversight requirements, especially for high-risk AI systems used in pricing and underwriting</li>
<li><strong>DORA (Regulation 2022/2554):</strong> Ensures digital resilience against cyber threats, covering AI used in operational processes</li>
<li><strong>GDPR &amp; Greek Law 4624/2019:</strong> Enforces transparency and protects personal data processed by AI, with special rules for sensitive data like genetic information</li>
</ul>

<p style="text-align: center;">Two notions with an identical meaning</p>
<p style="text-align: center;">The ambiguous notion of insurance money under Greek Law</p>
<p>As early as 2001, EU law (Directive 2001/17 on the reorganization and winding-up of insurance undertakings, which has  been incorporated into Directive 2009/138) provided the definition of the concept of “insurance claims” so that national legislation could include in the preferential creditors of an insurance undertaking those who derive rights from an insurance contract, including injured third parties, who have a right of direct action against the insured driver&#8217;s civil liability insurer, with a claim for their compensation. However, since the compensation owed to injured third parties consists in nothing else than insurance money, Greek law and long-standing Greek practice and theory, of course, did not exclude from the privilege conferred to insureds the claims for compensation of injured third parties who have a right of direct action against the liability insurer of the injuring party, such third parties being confined in Greece to the victims of road accidents, as the latter were &#8211; and continue to be &#8211; statutorily treated more favorably than even the insured himself, considering that the insurer cannot invoke objections deriving from the insurance contract against such third parties (e.g. the insurer cannot invoke against the third injured party in order to refute the latter’s claim that the insured driver who caused the accident was drunk while driving). The concept of beneficiaries of “insurance claims&#8221;, according to the Greek text of Directive 2009/138 (Solvency II), refers to those who have a claim under an insurance contract or based on an insurance contract, i.e., to the beneficiaries of insurance money under Greek law. This is because, as provided by law, the beneficiaries of insurance money are the policyholder or the third party (-ies) to which the insurance undertaking is obliged to <em>“…make payments or, if specifically agreed, make provision in kind on the occurrence of the event on which it has been agreed that the insurer’s obligation depends</em>”</p>
<p>Ήδη από το 2001 το ενωσιακό δίκαιο (Οδηγία 2001/17 για την εξυγίανση και την εκκαθάριση των ασφαλιστικών επιχειρήσεων που σήμερα ενσωματώθηκε στην Οδηγία  2009/138) έδωσε τον ορισμό της έννοιας «δικαιούχοι από ασφάλιση» για να περιλάβουν οι εθνικές νομοθεσίες στους προνομιούχους πιστωτές μιας ασφαλιστικής επιχείρησης όσους αντλούν δικαιώματα από ασφαλιστική σύμβαση, συμπεριλαμβανομένων των τρίτων ζημιωθέντων που έχουν ευθεία αγωγή κατά του ασφαλιστή αστικής ευθύνης του ασφαλισμένου οδηγού, με αίτημα την αποζημίωσή τους. Πλην όμως, επειδή η αποζημίωση των τρίτων ζημιωθέντων δεν ήταν κάτι άλλο από το ασφάλισμα, ο ελληνικός νόμος και η μακρά ελληνική πρακτική και θεωρία, αυτονοήτως δεν εξαιρούσαν του προνομίου τις αξιώσεις αποζημίωσης των τρίτων ζημιωθέντων που είχαν ευθεία αγωγή κατά του ασφαλιστή, που στην Ελλάδα ήταν μόνο τα θύματα τροχαίων, αφού, κατά μείζονα, λόγο αυτοί αντιμετωπίζονταν και αντιμετωπίζονται από την νομοθεσία ευνοϊκότερα και από τον ίδιο τον ασφαλισμένο καθόσον ο ασφαλιστής δεν μπορεί να προβάλει κατ’ αυτών ενστάσεις από την ασφαλιστική σύμβαση (π.χ. ο ασφαλιστής δεν μπορεί να προβάλει στον τρίτο ζημιωθέντα προκειμένου να αποκρούσει την αξίωσή του ότι ο ασφαλισμένος οδηγός που προκάλεσε το ατύχημα βρισκόταν κατά την οδήγηση σε κατάσταση μέθης). Η έννοια «δικαιούχοι από ασφάλιση», κατά το ελληνικό κείμενο της Οδηγίας 2009/138 (Solvency II), αναφέρεται σε αυτούς που έχουν απαίτηση από μία ασφαλιστική σύμβαση ή στην βάση μίας ασφαλιστικής σύμβασης, δηλαδή στους, κατά το ελληνικό δίκαιο, δικαιούχους ασφαλίσματος. Τούτο, επειδή, όπως προβλέπει ο νόμος, δικαιούχοι ασφαλίσματος είναι ο λήπτης της ασφάλισης ή ο τρίτος στον/στους οποίο/ους υποχρεούται η ασφαλιστική επιχείρηση  να καταβάλει «…<em>παροχή (ασφάλισμα) σε χρήμα ή, εφόσον υπάρχει ειδική συμφωνία, άλλη παροχή σε είδος, όταν επέλθει το περιστατικό από το οποίο συμφωνήθηκε να εξαρτάται η υποχρέωσή του</em>».</p>

<p><strong><u>Regulatory Innovation: Mystery Shoppers to Safeguard Consumers in the Financial Sector</u></strong></p>
<p>By virtue of a recently introduced provision (art. 77 of Law no. 5193/2025), the Bank of Greece (<a href="https://www.bankofgreece.gr">BoG</a>), in its capacity as the supervisory authority of enterprises of the financial sector (credit institutions, insurance companies) was empowered to use the technique of “<strong>mystery shopping</strong>” to effectively assess the quality of products and services provided by credit institutions and distributors of insurance products, i.e., insurance companies and insurance intermediaries. Mystery shopping shall be carried out by either BoG’s employees or by external partners who shall impersonate real customers without revealing their identity, thus collecting information on the conditions of the transaction, the level of the services provided as well as the compliance of the supervised enterprises with both the legislative provisions and the rules of conduct pertaining to their activities. The information collected by the mystery shoppers will be provided in real time to the BoG, which, in case of detection of infringements of the legislation governing the activity of the supervised entities, may take all appropriate repressive measures, including the imposition of sanctions.</p>

κατά τον νέο Κώδικα<br />
Ιδιωτικού Ναυτικού Δικαίου</p>

<p>Η ασφαλιστική σύμβαση θαλάσσιων κινδύνων ρυθμίζεται  κυρίως από στερεότυπους διεθνείς ασφαλιστικούς όρους και πολύ περιορισμένα από τις  ειδικές διατάξεις  τόσο του προϊσχύσαντα όσο και του νέου ΚΙΝΔ. Ο νέος ΚΙΝΔ «βεβαιώνει» ότι οι διατάξεις του μέρους για την θαλάσσια ασφάλιση έχουν την φύση ασφάλισης ζημιών. Αποτελείται το μέρος αυτό από ειδικές διατάξεις του δικαίου της ασφαλιστικής σύμβασης ζημιών πραγμάτων. Η σύνδεση του μέρους αυτού του νέου ΚΙΝΔ με τον νόμο για την ασφαλιστική σύμβαση, παρουσιάζει ορισμένα ζητήματα που εντοπίζονται στις παρούσες πρώτες σκέψεις.</p>
<p>1. Το 10<sup>ο</sup> μέρος του νέου Κώδικα Ιδιωτικού Ναυτικού Δικαίου [ΚΙΝΔ] (νόμος 5020/2023)<a href="#_ftn1" name="_ftnref1"><sup>[1]</sup></a> και με τίτλο «Θαλάσσια ασφάλιση» και ημερομηνία έναρξης ισχύος την 1.5.2023, περιέχει διατάξεις του δικαίου της «<strong>σύμβασης θαλάσσιας ασφάλισης</strong>» (άρθρα 252-271), που αντικαθιστούν διατάξεις της ίδιας θεματικής του προϊσχύσαντα κώδικα (στο εξής «πρ. ΚΙΝΔ», άρθρα 257-288) που στην ουσία είχαν περιπέσει σε αχρησία<a href="#_ftn2" name="_ftnref2"><sup>[2]</sup></a>. Αποτελεί μέρος μιας συνολικά λίαν αξιόλογης προσπάθειας ανανέωσης και επικαιροποίησης της βασικής νομοθεσίας του ελληνικού ιδιωτικού ναυτικού δικαίου.</p>
<p>Το άρθρο 252 του ανανεωμένου ΚΙΝΔ (στο εξής ΚΙΝΔ), όπως και το άρθ. 257 του πρ. ΚΙΝΔ, αιτιολογεί την ύπαρξη και δεύτερου δικαίου για την ασφαλιστική σύμβαση, στο ότι ο νόμος 2496/1997 (ΑσφΝ) περιέχει και διατάξεις ασυμβίβαστες με την θαλάσσια ασφάλιση. Όμως, οι διατάξεις για την θαλάσσια ασφάλιση του ΚΙΝΔ αποτελούν ασφάλιση που έχει τη φύση της <strong>ασφάλισης</strong> <strong>ζημιών</strong><a href="#_ftn3" name="_ftnref3"><sup>[3]</sup></a> και, εκείνες εξ αυτών που ο πυρήνας τους δεν αποτελεί επανάληψη διατάξεων του ΑσφΝ<a href="#_ftn4" name="_ftnref4"><sup>[4]</sup></a>, συνιστούν <strong>ειδικές διατάξεις του δικαίου της ασφαλιστικής σύμβασης</strong><a href="#_ftn5" name="_ftnref5"><sup>[5]</sup></a><strong>,</strong> όπως άλλωστε και οι λακωνικές διατάξεις του Β΄ κεφαλαίου του Β΄ μέρους του ΑσφΝ<a href="#_ftn6" name="_ftnref6"><sup>[6]</sup></a> με τίτλο «είδη ασφάλισης ζημιών». Εννοείται ότι οι διατάξεις αυτές, επειδή ρυθμίζουν επιμέρους είδη ασφάλισης, δεν θα εφαρμοστούν κατ’ αρχήν άμεσα σε διαφορετικά είδη ασφάλισης, ενώ και οι γενικές διατάξεις του όλου ΑσφΝ (άρθ. 1-9), καθώς και οι γενικές διατάξεις του μέρους του για την ασφάλιση ζημιών (άρθ. 11-18 ΑσφΝ) δεν θα εφαρμοστούν σε όρο ή διαμόρφωση της κάλυψης είδους ασφάλισης, στο οποίο δεν αρμόζουν ή για το οποίο έχει έγκυρα συμφωνηθεί διαφορετική ρύθμιση. Χαρακτηρίζουμε δε τις διατάξεις για την θαλάσσια ασφάλιση του πρ. ΚΙΝΔ και του ΚΙΝΔ ως ασφαλίσεις κατά ζημιών, ακολουθώντας την διάκριση του συμβατικού ασφαλιστικού δικαίου σε ασφαλίσεις ζημιών (άρθ. 11-26 ΑσφΝ) και προσώπων (άρθ. 27-32 ΑσφΝ) –καθότι οι διατάξεις για την θαλάσσια ασφάλιση του ΚΙΝΔ αποτελούν συμβατικό δίκαιο– και όχι με βάση τη διάκριση του εποπτικού δικαίου το οποίο, κατά την ταξινόμηση των κλάδων ασφάλισης, εντάσσει στις κατά ζημιών ασφαλίσεις, μεταξύ άλλων, και τις ασφαλίσεις ατυχημάτων και ασθενειών (άρθ. 4 ν. 4364/2016)<a href="#_ftn7" name="_ftnref7"><sup>[7]</sup></a>.</p>
<p><a href="#_ftnref1" name="_ftn1"><sup>[1]</sup></a> Εγκρίθηκε από την Ολομέλεια της Βουλής την 9.2.2023 ως κώδικας με τον νόμο 5020/2023 «Κώδικας Ιδιωτικού Ναυτικού Δικαίου και άλλες επείγουσες διατάξεις του Υπουργείου Ναυτιλίας και Νησιωτικής Πολιτικής» (ΦΕΚ Α΄ 29 της 15<sup>ης</sup>.02.2023).</p>
<p><a href="#_ftnref2" name="_ftn2"><sup>[2]</sup></a> Ενδιαφέρουν την θαλάσσια ασφάλιση και οι διατάξεις των άρθ. 33, για την ασφάλιση ενυπόθηκου πλοίου και άρθ. 282 (β), για την 2ετή παραγραφή.</p>

<p><a href="#_ftnref5" name="_ftn5"><sup>[5]</sup></a> Ο Γαλλικός Code de Commerce του 1807 που μεταφέρθηκε αρχικά στον, ακόμα σε ισχύ, Εμπορικό Νόμο της Ελλάδος του 1835 (ΕμπΝ), περιείχε διατάξεις μόνο για την θαλάσσια ασφάλιση, ενώ συγκεντρωμένες διατάξεις για την χερσαία ασφάλιση εισάχθηκαν το πρώτον το 1910 με προσθήκη στον ΕμπΝ. Η διάκριση μεταξύ δικαίου της θαλάσσιας και της χερσαίας ασφάλισης ανάγεται στην υπερ200ετή διάκριση των εμπορικών συναλλαγών του θαλάσσιου από αυτές του χερσαίου εμπορίου και την εντεύθεν ένταξη της μεν θαλάσσιας ασφάλισης στο ναυτικό δίκαιο – αν και σήμερα δεν μπορεί να λεχθεί ότι είναι θεσμός του ναυτικού δικαίου – των δε μη θαλάσσιων κινδύνων, στις διατάξεις για το χερσαίο εμπόριο. Συνεπώς, από την οπτική αυτού του ιστορικού δυϊσμού και με έρεισμα την παράδοση, <strong>η ασφάλιση μπορεί σήμερα να είναι είτε θαλάσσια ή αεροπορική είτε χερσαία</strong>. Ο σεβασμός στην παράδοση σε συνδυασμό με την λακωνικότητα του ΑσφΝ είναι λόγοι που δικαιολογούν την μη ένταξη του δικαίου της θαλάσσιας ασφάλισης στο δίκαιο των ασφαλίσεων κατά ζημιών μη προσώπων του νόμου για την ασφαλιστική σύμβαση – ΑσφΝ- όπου ανήκουν· όχι ότι η ασφαλιστική σύμβαση κατά θαλασσίων κινδύνων αποτελεί διαφορετικό δίκαιο από το δίκαιο της ασφαλιστικής σύμβασης και ότι απαιτείται οπωσδήποτε να ρυθμίζεται από ένα ξεχωριστό νομοθέτημα από τον ΑσφΝ. Εννοείται ότι ούτε διαφορετικό εποπτικό δίκαιο ούτε διαφορετικές εποπτικές Αρχές ισχύουν για την θαλάσσια ασφάλιση· κάθε ασφαλιστική επιχείρηση που ασκεί, μεταξύ άλλων ή αποκλειστικά, τους κλάδους ασφάλισης που αφορούν θαλάσσιους κινδύνους, δηλαδή τους ταξινομημένους κλάδους ασφάλισης πλοίων και αστικής ευθύνης από θαλάσσια σκάφη – κλάδοι στ΄ και ιβ΄ του άρθ. 4 του ν. 4364/2016 – εποπτεύεται από την Τράπεζα της Ελλάδας, όπως συμβαίνει με όλες αδιακρίτως τις ασφαλιστικές επιχειρήσεις.</p>
<p><a href="#_ftnref6" name="_ftn6"><sup>[6]</sup></a> Πρόκειται για τις ασφαλίσεις πιστώσεων και εγγυήσεων (άρθ. 22 ΑσφΝ), εσοδείας (άρθ. 21), μεταφοράς πραγμάτων (άρθ. 20), διακοπής λειτουργίας επιχείρησης (άρθ. 24), περιβαλλοντικών ζημιών (άρθ. 23) και πυρός (άρθ. 19).</p>
<p><a href="#_ftnref7" name="_ftn7"><sup>[7]</sup></a> Η παραπομπή που κάνει το άρθ. 252 παρ. 1 στην εφαρμογή των διατάξεων του νόμου για την ασφαλιστική σύμβαση στο μέτρο που οι διατάξεις του δεν είναι ασυμβίβαστες με την ασφάλιση αυτή και δεν τροποποιούνται από το παρόν, όπως έκανε και το άρθ. 257 του πρ. ΚΙΝΔ, δημιουργεί ασάφεια που δεν αρμόζει στις σύγχρονες συναλλαγές, ιδίως μετά την προ 26ετίας εισαγωγή του φιλοκαταναλωτικού ΑσφΝ. Για αυτό, είναι επιτακτικό να κάνει χρήση το θαλάσσιο ασφαλιστήριο της ευχέρειας που έχει να ορίζει ότι δεν θα εφαρμόζεται ο ΑσφΝ, ώστε να αποφεύγεται η αναζήτηση της συμβατότητας και έτσι να διέπεται η σύμβαση ολοκληρωμένα από τους ασφαλιστικούς όρους.</p>
