Cross Border Insurance Claim

Rokas Law Firm has undertaken the successful handling of a cross border insurance claim, brought before the High Court (Kings Bench division) in London against our client, the Greek insurance company Eurolife FFH, in relation to a road traffic accident which occurred in Greece. The English claimant was cycling and crashed on the insureds parked car, sustaining life-changing injuries. The claimant brought a claim of 7 mio EUR excluding general damages, against the Greek insurance company in the UK and the High Court applied Greek Law to rule on the parties’ negligence and liability. Our Senior Associate, Sofia Getimi provided continuous support in relation to all substantive matters of Greek law governing the claim and our Partner – Head of Litigation, Christos Theodorou guided the team through the complexities of this case.

Rokas team also provided decisive support to the solicitors and barrister appearing before the court in relation to the application of Greek law leading to the acceptance of all of our  legal arguments by the UK court and the exoneration of the Greek insurance company from all liability.

“MR JONATHAN GLASSON KC SITTING AS A DEPUTY JUDGE OF THE HIGH COURT:

The Claimant claims damages for personal injury arising from a road traffic collision which occurred in Greece at around 1130 hours on 16 September 2019 (“the collision”, or “the accident”). The Claimant was on holiday at the Neilson Buca Beach Resort (“the Resort”) with his wife. On the morning of 16 September, he hired a bike from the Resort. As he was cycling along a
two-way national road in the Peloponnese region of mainland Greece he collided with a black Opel Vectra motor vehicle (bearing registration mark IZM-6814) which was parked in the shade of a tree on the right-hand side of the road. Although the full extent of his injuries was not immediately apparent, it has transpired that the Claimant had suffered catastrophic spinal injuries and is permanently tetraplegic.”
